## What it is
The state licensing office's June 2026 quarterly webinar: pool and drowning safety, background checks for staff and volunteers, and licensing updates.

## 3 things to know
- Homes with in-ground pools (in single-family houses) need a 60-inch enclosure, ASTM cover or alarm, life ring, and rescue pole. [presenter said at 00:38:33, not independently confirmed]
- Staff, volunteers and adults living there need criminal record clearance or exemption plus CACI clearance before being present, with limited exceptions. - Start every background check in Guardian and use its Live Scan form (LIC 9163), so results match the right person and facility. [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=34]

## What to do
- All licensees: give families the Risks and Effects of Lead Poisoning flyer (PUB 515) at enrollment and re-enrollment. [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=12]
- Child care centers: check when your 5-year repeat lead test is due. It started coming due for some centers in July 2026. Funding for testing and remediation was still available in June. (deadline: Some centers from July 2026) [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=12]
- If you have an in-ground pool, check it against HSC 1596.814 and PIN 25-01-CCP: the enclosure, gate, cover or alarm, and the life ring and rescue pole (earlier CDSS slides say all licensed facilities with a pool need these). [presenter said at 00:37:02, not independently confirmed]
- Make sure every staff member, volunteer and adult who needs one has a criminal record clearance or exemption and a CACI clearance before they are present. ## Lead testing reminder
- Lead can harm a child's developing brain and nervous system even at low levels. Children from birth to 6 are most at risk. [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=12]
- All licensees must give families the lead poisoning flyer (PUB 515) at enrollment and re-enrollment. [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=12]
- The 5-year repeat lead test comes due for some child care centers as early as July 2026, and funding for testing and remediation was still available. Details are on the Lead Toxicity Prevention and Water Testing Information page under Quick Links. [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=12]

## Get licensing updates by email
- Sign up for the CDSS distribution list ("Receive Important Updates" on the CDSS homepage, or the QR code) to get PINs by email. [presenter said at 00:15:12, not independently confirmed]

## Drowning prevention for children with disabilities (The Arc of California)
- Children with autism spectrum disorder are 160 times more likely to drown than their neurotypical peers, according to a 2017 Columbia University study cited on the slide. [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=15]
- The slide says half of children with autism wander, and 70-80% of childhood drowning happens in a backyard pool. The speaker said any body of water counts, even a shallow one. [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=15]
- Map the bodies of water near your site, so you know where to check first if a child wanders. [presenter said at 00:23:09, not independently confirmed]
- Near-drowning can cause lifelong disabilities, such as brain damage, seizures and learning disabilities.

## Secondary drowning and signs of drowning
- Secondary drowning can follow a near-drowning, and symptoms may not appear for up to 48 hours. [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=18]
- After any water scare, tell parents what signs to watch for, and go to the emergency room right away if symptoms appear. [presenter said at 00:27:41, not independently confirmed; presenter said at 00:28:39, not independently confirmed]
- Drowning is often silent: no warning, no splashing, no sounds. Train staff to recognize it. DDS has printable drowning prevention materials. [presenter said at 00:31:20, not independently confirmed]
- The speaker encouraged water safety training, swim lessons, and working with families on water safety. [presenter said at 00:33:21, not independently confirmed]

## Why water safety rules matter
- Per the Department of Developmental Services, drowning is a leading cause of accident-related deaths for children under five and children with autism. Per the CDC, it is the second most common cause of death for U.S. children ages 5 to 14. [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=21]

## Pool safety law (AB 2866)
- AB 2866 (2024) added pool rules for in-ground pools. They apply to child care centers, and to family child care homes in private single-family homes, that have in-ground pools. See PIN 25-01-CCP. [presenter said at 00:35:59, not independently confirmed]
- The presenter said centers had to comply with HSC 1596.814 starting January 1, 2025. [presenter said at 00:37:02, not independently confirmed]

## Pool rules for child care centers
- An in-ground pool must be enclosed by a fence, wall or barrier. An indoor pool may instead have a self-closing door with a high latch or other access control, such as a key card or code. [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=23]
- A second safety feature, such as an alarm, is also required to prevent unsupervised access. [presenter said at 00:37:42, not independently confirmed]

## Pool rules for family child care homes
- These rules apply only to homes in a private single-family dwelling with a pool, not to all family child care homes. [presenter said at 00:38:33, not independently confirmed]
- The pool must be enclosed by a fence, wall or barrier that isolates it from the home. [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=24]
- You also need an ASTM-compliant pool cover or pool alarm. The alarm must sound when someone enters the water. [presenter said at 00:39:20, not independently confirmed]
- Keep a U.S. Coast Guard-approved life ring (at least 17 inches across) and a rescue pole with a body hook (at least 12 feet long) available. [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=24]

## Pool enclosure requirements (HSC 1596.814)
- The gate must open away from the pool and be self-closing and self-latching, with a key-lockable latch at least 60 inches off the ground. [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=25]
- The enclosure must be at least 60 inches tall, with no more than 2 inches of clearance at the bottom. [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=25]
- If you key-lock the gate, keep the key immediately reachable for anyone providing care. [presenter said at 00:41:31, not independently confirmed]
- No gaps a 4-inch sphere could pass through, and nothing on the outside a child could use to climb. Keep furniture, toys and other objects away from the fence. [presenter said at 00:42:58, not independently confirmed]
- Mesh fencing that does not otherwise meet these rules needs documentation showing it meets ASTM International Standard F2286. [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=26]

## Above-ground pool recall
- About five million above-ground pools, 48 inches and taller with compression straps on the outside of the support poles, were recalled. The straps can act as footholds. [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=27]
- The presenter said the CPSC reported nine children aged 22 months to 3 years drowned after climbing in this way. See PIN 25-16-CCLD. [presenter said at 00:44:54, not independently confirmed]

## Center staffing for water activities
- Ratios during water activities are one adult for every six preschool children and one adult for every two infants (1:4 if infants are independent in water). [presenter said at 00:46:27, not independently confirmed]
- Lifeguards, or staff supervising anyone other than center children, do not count toward the ratio. [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=28]
- Inflatable or portable wading pools must be emptied after each use. [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=28]
- At least one adult present must hold a valid water-safety certificate (on file) and CPR/First Aid. [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=28]

## Criminal record background checks
- HSC 1596.871 requires fingerprints from people whose contact with children may pose a risk to their health and safety. [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=30]
- Before first being present in the facility, a person needs a criminal record clearance or exemption, plus a Child Abuse Central Index (CACI) clearance. The licensee is responsible for making sure this is done. [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=30]
- Fingerprints go to the California Department of Justice before a person starts work, moves into a licensed home, or is present in a role that needs a check. [presenter said at 00:49:46, not independently confirmed]
- CDSS may allow a current clearance to be transferred to another licensed facility if requirements are met, using form LIC 9182. [presenter said at 00:50:07, not independently confirmed]

## Who needs a background check
- Besides the applicant: administrators and staff supervisors, anyone other than a child who lives in the facility, anyone providing care and supervision, and any staff, volunteer or employee with contact with children. [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=32]

## Who is exempt, including some volunteers
- Some people are exempt: a volunteer giving time-limited specialized services who is directly supervised, at the facility no more than 16 hours a week, and never left alone with children. [presenter said at 00:52:02, not independently confirmed]
- Also exempt: students at an accredited educational institution; volunteers who are a relative, legal guardian or foster parent of a child in care; contracted repair people; and people in similar roles. Each has conditions in the statute. [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=33]
- When unsure, ask your Licensing Program Analyst. [presenter said at 00:52:46, not independently confirmed]

## Guardian and the Live Scan form
- Background checks are processed in Guardian. Start every application there to avoid delays, and use the Live Scan form (LIC 9163) it generates, so results match the right person and facility. [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=34]
- Using a wrong or outdated Live Scan form is a common cause of delays. See PIN 21-22-CCLD and the webinars on the Guardian home page. [presenter said at 00:54:01, not independently confirmed]

## Filling out LIC 9163
- Fill out the whole form; leave nothing blank. The ORI is preprinted (A0448), and volunteers check the "Volunteer" box. [presenter said at 00:54:48, not independently confirmed]
- Enter your facility number. Without it, the person may be cleared but not linked to your facility, which can still lead to a citation. [presenter said at 00:55:12, not independently confirmed]
- The employer is the center's name, or for a home provider, your first and last name. Complete the form before booking a Live Scan appointment. [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=35]

## Technical Support Program training
- The Technical Support Program (former licensing analysts) can train you and your staff on topics such as care and supervision, personal rights, record keeping and staff qualifications. Contact your regional TSP analyst or ask your Licensing Program Analyst for a referral. [presenter said at 00:56:04, not independently confirmed]

## Reminders
- A language poll asked which languages attendees speak, read and write, to plan interpretation.
- Tell your Licensing Program Analyst or regional office about changes to your phone, email, location, operation or physical plant. [presenter said at 01:01:00, not independently confirmed]
- Remaining 2026 statewide webinars are on Tuesdays, September 22 and December 8, from 6:00 to 7:30 p.m. Registration is announced through PINs. [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=41]
- Questions: your regional office, the Child Care Advocate Program (ChildCareAdvocatesProgram@dss.ca.gov), or Child Care Assistance at (800) 543-7793. [✓ official source: https://cdss.ca.gov/Portals/9/CCLD/June%202026%20Q2%20Statewide%20PP%20deck.pdf#page=42]
