3 things to know

  1. From October 1, 2027, staff who provide care, plus home licensees and substitutes, need health and safety training and 12 yearly hours.✓ checkedCurrent rule: the October 1, 2027 requirement is at least 16 hours of health and safety training (15 hours plus 1 hour of nutrition), not 15 (PIN 26-11-CCP, checked 2026-09-29). current rule
  2. Emergency and disaster plans must meet new requirements from January 1, 2027, including 72 hours of self-reliance and two relocation sites.✓ checked
  3. Mandated reporter training no longer has a limited-English exemption: every licensee and staff member must take it and renew every two years.✓ checked

Welcome and professional growth hours
  • If you attend the live webinar from start to end, Zoom sends a follow-up email that you can use as proof for professional growth hours.
  • The moderator said not every question might be answered and invited follow-up questions to the Child Care Advocates email.
What AB 150 and AB 190 change
  • AB 150 and AB 190 are trailer bills enacted June 29, 2026 and September 18, 2026. They update the Health and Safety Code for licensed child care.✓ checked
  • The changes cover temporary absence in family child care homes, medication, an anaphylactic policy, health and safety training, mandated reporter training, and emergency and disaster plans.
Giving medication
  • Amended HSC 1596.798 lets child care facilities give any medication, not only inhaled medication, with written permission from the parent or guardian and written instructions from the child's healthcare provider.✓ checked
  • The healthcare provider's instructions must be updated every year.✓ checked
Anaphylactic policy and epinephrine
  • CDSS must set an anaphylactic policy for trained staff to prevent and respond to anaphylaxis emergencies, by July 1, 2027.✓ checked
  • Under amended HSC 1596.7985, starting January 1, 2028, facilities must follow the policy and give families written notice of it at enrollment.✓ checked
  • 'Epinephrine auto-injector' now includes other FDA-approved delivery systems, such as epinephrine nasal sprays, used under the policy for a child who has or is reasonably believed to have anaphylaxis.✓ checked
  • This matches the national Caring for Our Children standard on food and other allergies (4.2.0.10).
Health and safety training and 12 yearly hours
  • Amended HSC 1596.866 expands who needs health and safety training: pediatric first aid, pediatric CPR and preventive health practices. The slides say at least 15 hours; PIN 26-11-CCP says at least 16 (15 hours plus 1 hour of nutrition), which is what presenters said in Q&A.✓ checkedCurrent rule: the October 1, 2027 requirement is at least 16 hours of health and safety training (15 hours plus 1 hour of nutrition), not 15 (PIN 26-11-CCP, checked 2026-09-29). current rule
  • From October 1, 2027 this applies to all staff providing care in a center, all family child care licensees, all staff providing care in a family child care home, and each substitute adult in a family child care home.✓ checked
  • Also from October 1, 2027, the same people must complete 12 hours of continuing education every year, as a condition of licensure, from Department-approved sources, and keep proof.✓ checked
  • Topics for the 12 hours (PIN 26-11-CCP): emergency and disaster planning; building and premises safety; safe sleep and SIDS prevention; preventing shaken baby syndrome, abusive head trauma and maltreatment; transporting children; infectious diseases; food and allergy emergencies; hazardous materials; and giving medication with parental consent.✓ checked
  • This matches the national Caring for Our Children standards on professional development (1.4).
Mandated reporter training
  • Before, licensees and staff with limited English were exempt if the training was not offered in their primary language. Amended HSC 1596.8662 removes that exemption.✓ checked
  • All licensees and staff must now complete mandated reporter training and renew it every two years, whatever their English level.✓ checked
  • Online, self-paced mandated reporter training is available in English, Spanish, Chinese (Simplified and Traditional) and Vietnamese. If you were exempt and need help, contact your regional office.✓ checked
Emergency and disaster plans
  • Starting January 1, 2027, HSC 1596.868 requires every child care facility to have an emergency and disaster plan on file that meets specific requirements. The licensee is responsible for it, and is encouraged to have local emergency authorities review it.✓ checked
  • The plan must include shelter-in-place procedures for severe weather or other hazards, and plans to be self-reliant for at least 72 hours after an emergency, including a short- or long-term power failure.✓ checked
  • The presenter also said the plan should cover utility outages: if you plan to shelter in place and water, sewer, gas or electricity may be out, have a plan and supplies for alternate resources. For a permanent generator, give its location and how it will be used; for a portable generator, follow the manufacturer's operating instructions.
  • Relocation procedures must include a transportation plan, communication with emergency responders, evacuation route information and temporary shelter locations.✓ checked
  • Name at least two places to temporarily shelter children if you must relocate. At least one must be outside your immediate geographic area.✓ checked
  • PIN 26-11-CCP adds: train new staff and volunteers on the plan before they start and every year; hold practice drills at least quarterly and keep records; review the plan every year; have keys available during an evacuation; give the plan to parents or emergency responders who ask. New license applicants submit a plan with the application.✓ checked
  • This matches the national Caring for Our Children standard on emergency procedures (3.4.3).
Temporary absence in family child care homes
  • Slide 10 cites HSC 1597.63. The presenter said the licensee must be in the home and make sure children are supervised during operating hours.
  • If the licensee must be away while children are present, a qualified substitute adult must care for them. The licensee can be away no more than 20% of the home's care hours in any calendar month.✓ checked
  • Before ever providing care, a substitute needs criminal record clearance (or exemption), the health and safety training, and immunizations for flu, pertussis and measles.✓ checked
  • The home must give parents written notice before the absence (in an emergency, no later than the next business day) and keep records showing it meets these rules.✓ checked
  • This matches the national Caring for Our Children supervision standards (1.1.1.1 and 1.1.1.2).
PIN 26-11-CCP and what's coming
  • Watch your email for more webinars on these changes, PINs with more guidance, and state plan input sessions.✓ checked
  • PIN 26-11-CCP (September 25, 2026) summarizes the 2026 budget trailer bills and what centers and homes need to do. CDSS may issue interim licensing standards that carry the force of regulations until regulations are adopted.✓ checked
  • The December webinar is Tuesday, December 8, 6:00 to 7:30 p.m., with guests from PBS and a discussion on self-care and reflection. Watch for the PIN with the new registration link.

Questions people asked

Will there be money for training costs and staff overtime, and can the deadline be extended?

A presenter said AB 190 moved the training date: from October 1, 2027, required people need the health and safety training (said as 16 hours) with current pediatric first aid and CPR, plus 12 hours of continuing education a year. CDSS is gathering resources and training lists. For the emergency plan, the January 1, 2027 date is in law; guidance will come through PINs and the CDSS website. The moderator said no financial assistance is tied to this legislation.

How soon after hiring do staff need CPR, first aid and preventive health training?

This takes effect October 1, 2027. From then on, staff need it as they join. The moderator said that currently at least one person on site at a center must be certified in CPR and first aid.

Can staff take the current 8-hour health and safety course now and add the rest later?

The presenter said the 16 hours are two classes: 8 hours of first aid and CPR, which must be current and is renewed every 2 years, and an 8-hour preventive health class (including nutrition and lead) that is taken once, can be taken now, and does not expire. The 12 yearly hours are separate.

Do resource and referral (R&R) agency trainings count toward the 12 yearly hours?

Not at this time. Only CECO trainings are approved so far; other sources are being looked at, and more information will follow.

Do I have to give medication now, if I only handle inhalers and EpiPens?

No. The bill removed the word 'inhaled', so the rule covers all medication, but licensees and staff 'may' give medication, following HSC 1596.798.

Do parents in a parent cooperative preschool need the training?

Not in a license-exempt program. In a licensed parent cooperative, yes, as in any licensed facility. CDSS will issue interim licensing standards (ILS) that define 'staff' more clearly.

Does the health and safety course at a community college count toward the initial training?

Yes. Nothing has changed; that preventive health training is still available at community colleges.

If a family member who lives with me is alone with the children for pickup or while I'm at a doctor's appointment, do they need the yearly training?

Yes, from October 1, 2027. Anyone who cares for children counts as staff and must meet all staff requirements. Ratios must also be met.

Will CDSS make templates to help providers comply?

Templates are a popular request and are being elevated. CDSS is creating supplemental resources, such as PINs and trainings on each topic.

How can a center without vehicles meet the transportation part of the plan?

You don't have to buy a bus or van. You need a plan for how you would transport children in an emergency. More resources are coming.

Will the PowerPoint be shared?

Yes. The slides (PDF) are posted on the CDSS webpage. The recording takes about a month and a half to be posted (later also said as 'the next few weeks').

Which regulations does the emergency evacuation plan have to meet?

See the PIN released this week (PIN 26-11 CCP). It links to the regulations and breaks down the requirements.

Do we keep using the same disaster plan form?

For now, yes: the current forms, heard as '610' and '610A'. New resources will be shared as implementation gets closer.

Is the 72-hour shelter-in-place mandatory, and how do we move children if the site is an hour's walk away?

Review what the law says and make a plan for what you would really do. CDSS will break this down later and share resources to help you build a plan for your center or home.

What does 'outside the immediate geographic area' mean? Outside the neighborhood?

Not defined yet. The idea is a safe place that won't face the same risk, since in past emergencies evacuation sites were also evacuated. It depends on where you are; CDSS will work with LPAs on more tailored guidance.

Does our own yearly emergency and safety training count toward the 12 hours?

One presenter said it counts if it covers all the topics listed in the Health and Safety Code. Another reminded that, at this time, only the free online CECO trainings are approved for the 12 hours.

Do large family child care homes and centers still need monthly emergency drills?

Presenters said the rule changed from every six months to quarterly, and encouraged monthly drills as best practice. PIN 26-11-CCP says all child care facilities must hold practice drills at least quarterly.

Do behavioral therapists or other support staff who are not counted in ratio need first aid, CPR and preventive health training?

Not answered. The question was elevated; follow up through the Child Care Advocates email.

How do I get proof that I attended?

Zoom sends a follow-up email to the address you registered with. It is not a certificate.

Is there funding or group rates for the health and safety training?

No money comes with this law. Ask training providers whether they offer group help.

Who do providers send records of the 12 hours to?

No one. Keep them at your site, such as in employee files. They don't go to your LPA or regional office.

Where is the list of trainings for the 12 hours?

Check PIN 26-11-CCP, which has sections on emergency planning, the anaphylactic policy, training, mandated reporter training and the 80-20 absence rule, and lists the topics the 12 hours must cover. A CECO link was shared in chat.

Can the health and safety courses be taken online?

First aid and CPR is hands-on; you must attend in person. The EMSA website lists classes.

Does every teacher, aide and substitute need the training, and does it expire?

Yes, from October 1, 2027, all staff who work with children need first aid, CPR and the 8-hour preventive health course. First aid and CPR last 2 years; preventive health is taken once.

Does an adult child living in the home need the training and the 12 yearly hours?

Yes, from October 1, 2027, if they help with the care and supervision of children.

Do college classes count toward the 12 hours?

Not settled. The presenter needed more information; she said licensing has specific trainings, and a college health and safety course could count as that one class.

Can the 20% absence be consecutive days?

The moderator's understanding is yes, based on the home's monthly operating hours. He suggested letting your LPA know.

How do the 12 yearly hours work?

The 12 hours are separate from the one-time and first aid classes. The clock starts October 1, 2027, so you don't need 12 hours done on that day. You can repeat the same class in a later year, but not the same class 12 times in one year.
